Claims Avoidance

Burns Associates advocates a Claims Avoidance philosophy as being the pre-condition to the avoidance of contractual disputes. Such philosophy starts with the development of a best practices regime from project inception until close out. There must be sufficient time allocated to develop the construction design to a point where changes to the specifications and construction drawings are minimized. Design reviews are recommended to achieve this objective together with readiness for construction reviews at appropriate times. Otherwise, clarity of the contract documents is paramount and consideration must be given to the allocation of risk to the party who is best placed to mitigate such risk.
